Uttarakhand has become the first state in independent India to implement the Uniform Civil Code (UCC), introducing a unified legal framework for marriage, divorce, inheritance, property rights, and adoption for all citizens, irrespective of their religion. The law comes into effect on January 27, 2025, following extensive preparations, including training sessions, legal approvals, and public awareness campaigns. This move fulfills a long-standing election promise of the Bharatiya Janata Party (BJP) and is seen as a significant step toward legal uniformity and gender equality in India.
The UCC replaces personal religious laws with a common civil law, ensuring that all citizens follow the same legal principles in personal matters. It standardizes the minimum marriage age at 21 for men and 18 for women, bans polygamy and triple talaq, mandates compulsory registration of marriages and live-in relationships, and grants equal inheritance rights to sons and daughters. The law also recognizes children born from live-in relationships as legitimate, securing their inheritance rights. However, Scheduled Tribes, comprising 2.89% of the state’s population, are exempt from this law due to their unique cultural traditions.
One of the most debated provisions is the mandatory registration of live-in relationships. Couples in live-in relationships must submit a legal declaration to the government. Failure to do so may result in a fine of up to ₹10,000 or imprisonment for up to three months. Providing false information in registration can lead to a fine of ₹25,000 or three months in jail, while non-compliance with a legal notice may result in six months of imprisonment or a ₹25,000 fine. The law also allows a woman abandoned in a live-in relationship to claim maintenance, similar to the rights granted in a marriage.
The Supreme Court of India has previously recognized live-in relationships and their legal implications. In 2010, the Supreme Court ruled that children born from live-in relationships are legal heirs with full inheritance rights. Uttarakhand’s UCC formalizes these principles by providing a structured legal framework for such relationships, aiming to ensure protection for women and children.
The implementation of the UCC is expected to have far-reaching political and legal implications. Chief Minister Pushkar Singh Dhami emphasized that the law will promote gender equality, social harmony, and legal consistency, while critics argue that it interferes with religious and personal freedoms. The move has sparked debates among religious and political groups, with some claiming that the UCC may infringe on cultural diversity.
The political impact of the UCC extends beyond Uttarakhand. Other BJP-governed states such as Gujarat, Assam, and Madhya Pradesh have expressed interest in implementing similar laws. The success of the Uttarakhand UCC could serve as a blueprint for a national-level Uniform Civil Code, a long-standing goal of the ruling party.
Supporters of the UCC believe that it ensures equal rights, modernizes outdated personal laws, and strengthens national unity by eliminating religious-based legal discrepancies. They argue that personal laws rooted in religious customs often discriminate against women, especially in matters of inheritance and divorce. On the other hand, opponents claim that the UCC disregards religious autonomy and imposes a one-size-fits-all approach that may not be suitable for India’s diverse cultural landscape.
